GULF THERAPY & AMANDA ABBOTT (GULF THERAPY) LIABILITY WAIVER

1. I, Participant, acknowledge that paddle boarding, and any water sport has inherent risks, hazards and dangers that cannot be eliminated. 

2. I,  Participant, shall obey all state, federal and local regulations, laws, ordinances, lawful directives from appropriate law enforcement personnel, and instructions from GULF THERAPY, its owners, volunteers, employees, and contractors while operating equipment from GULF THERAPY. Paddler is solely responsible for any citation or violation occurring during the use of, or as the result of using equipment from GULF THERAPY.

3. I,  Participant, represent that I am capable of safely operating and handling the equipment and find it in good working order, condition, and represent that I have adequate skills, knowledge, and experience to safely complete the planned activity and that adequate preparations have been made to ensure safe completion of activity.

4. I, Participant, shall bear all responsibility for any loss, theft or damage of the rental equipment, including but not limited to vandalism or theft, and shall pay GULF THERAPY the full cost of repair or replacement. 

5. I, Participant, acknowledge that Personal Floatation Devices (PFDs), to include but not be limited to lifejackets, are strongly recommended by GULF THERAPY, and GULF THERAPY strongly recommends Participant to use PFDs while using equipment whether in the surf zone or not. PFDs are the responsibility of the Participant to procure and utilize. Participant further acknowledges that while using equipment provided by GULF THERAPY a leash, as provided by GULF THERAPY, will be used at all times. The leash will not be a substitute for the recommendation to use PFDs. 

6. Release of liability: I, Participant, hereby indemnify GULF THERAPY, its owners, volunteers,  employees, and contractors of liability and release and/or hold harmless GULF THERAPY, its owners, volunteers, employees, and contractors from any loss, expense or cost, including attorney fees, arising out of any damage or injuries, whether to any persons or any property occurring as a result of rental or use of equipment.

7. I, Participant, am responsible for all parties using equipment during the agreed activity period. 

8. This Waiver constitutes agreement between GULF THERAPY and Participant, and no term may be waived or modified except in writing signed by both parties. There are no warranties expressed or applied, by GULF THERAPY to Participant, except as contained herein, and GULF THERAPY shall not be liable for any loss or injury to Participant nor to anyone else, of any kind or however caused. This agreement is one of bailment only and Participant is not GULF THERAPY’s agent while using said equipment. By signing this agreement, I agree that I am waiving rights to bring legal action to recover compensation or to obtain any other remedy for any injury, property or death, however caused, arising out of use of any equipment or programs of GULF THERAPY.
